Terms of Service - FloppyHost

These Terms of Service (“Terms”) govern your use of FloppyHost services, a brand of ATLADICA LLC, a U.S. company registered in New Mexico (“FloppyHost,” “we,” “our,” “us”). By creating an account, purchasing a service, or using our website, you agree to these Terms. If you do not agree, you may not use our services.

1. Eligibility

You must be at least 16 years old to use our services.
By registering, you confirm you have the legal capacity to enter into this agreement.

2. Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity under your account.

3. Services Provided

FloppyHost offers hosting services, including but not limited to Minecraft/game servers, web hosting, and related digital infrastructure.
We aim to provide 24/7 service availability but do not guarantee uninterrupted uptime.
We reserve the right to modify, suspend, or discontinue services at any time, with or without notice.

4. Payments & Billing

All fees are due upfront unless otherwise stated.
Payments are processed through third-party providers Stripe and PayPal.
You authorize us to charge your chosen payment method for recurring subscriptions.
Refunds are provided only in accordance with our Refund Policy (See section 14 near the end of this page).

5. Acceptable Use

You agree not to use our services for:

Illegal activities or content prohibited by U.S., EU, or international law.
Hosting or distributing malware, spam, DDoS, phishing, or abusive activities.
Infringement of intellectual property rights.
Activities that disrupt or harm our network or other users.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Data Protection

Our collection and use of personal data is governed by our Privacy Policy

7. Intellectual Property

All FloppyHost branding, software, and materials are owned by ATLADICA LLC.
You retain ownership of your content but grant us a license to host and deliver it as necessary to provide services.

8. Termination

You may cancel your account at any time through the client area.
We may suspend or terminate your account if you breach these Terms.
Upon termination, your data will be deleted in accordance with our data retention policy (generally 30 days).

9. Disclaimers

Services are provided “as is” without warranties of any kind, express or implied.
We do not guarantee that services will be error-free, secure, or continuously available.

10. Limitation of Liability

To the fullest extent permitted by law, FloppyHost and ATLADICA LLC shall not be liable for any indirect, incidental, or consequential damages.
Our total liability for any claim arising from your use of services shall not exceed the amount paid by you in the last 30 days.

11. Indemnification

You agree to indemnify and hold harmless FloppyHost, ATLADICA LLC, and its employees from any claims, damages, or expenses arising from your use of the services or violation of these Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of New Mexico, USA, and applicable U.S. federal law.
Disputes will first be attempted to be resolved informally. If unresolved, disputes shall be submitted to binding arbitration in New Mexico, unless prohibited by local law.

13. Changes to Terms

We may update these Terms from time to time. Continued use of our services after updates constitutes acceptance of the new Terms.

14. Refunds

We want our customers to be satisfied. If you are unhappy with your service for any reason, you may request a refund in the first 7 days of purchasing your service.
Refunds for specific reasons, such as technical issues, will apply only to the billing period (depends on subscription, per month etc.) in which the issue occurred.
Refunds will be issued back to your original payment method whenever possible.
Some costs that we pay to third parties (such as domain registrations or SSL certificates) cannot be refunded.
FloppyHost reserves the right to deny refund requests in cases of abuse, fraud, or violation of these Terms.

15. Service Availability

FloppyHost services are provided on a best effort basis. While we strive for reliable service, downtime, interruptions, or technical issues may occur.
By using our services, you acknowledge and accept that service interruptions or issues are possible and expected, you are responsible for keeping backups of your data outside of our service too.

16. Limitation of Liability

To the fullest extent permitted by law, FloppyHost and ATLADICA LLC shall not be liable for:
- Service downtime, outages, or technical failures.
- Loss of data, files, or content hosted on our servers.
- Indirect, incidental, or consequential damages of any kind.
Your sole remedy for dissatisfaction with the service is to request a refund as described above.
